Regarding Some Jurisprudencial Reflections of Privacy Violations in Social Media
Abstract
The impact of social media platforms on communication and interaction among people are being discussed in their positive and negative aspects by the experts. Considering the speed and convenience of sharing information, documents, images, sounds and as such, social media platforms’ positive effects on human life are irrefutable. On the other hand, voluntary disclosure and the changing perception of privacy in the face of such disclosure are among the negative effects of these platforms. Besides, privacy violations by unauthorized interventions from outside of the social media platforms highly occupy the agenda emphasizing the negative effects on the individual and community life. As a result of the said negative effects, it is alleged that privacy collapsed which prompted the scientific world to seek for a solution. Studies concerning the factors that led to the collapse and a solution are being conducted in the fields of psychology, sociology and law. The mainframe of this study is based on the problem mentioned above. At first, the privacy concept in Islamic Law is summarized and the extent of privacy is discussed. Thereafter, the negative effects of widely used social media platforms on the understanding of privacy on moral grounds, events that may occur following the reflections of those effects on society and necessary legal actions for those events are discussed. Also, modern law has been utilized in matters of the privacy of private life and individual rights.
