Media Exposal and its Effects as a Fact -Comperative Analysis in terms of Islam and Law-

Abstract

Exposal has got types ranging from normal to abnormal. Its judgement changes according to the situation, such as forbidden exposal and permissible exposal. Faqihs (Islamic Canonists) have put forth three points of view as re-gards with the indemnity of the exposal. First, it is permissible to meet the in-demnity of moral damages through material payment. Second, it is not always permissible to meet the indemnity of moral damages. Third, it is permissible to meet the indemnity of moral damages through material payment using ta'dhir (bodily punishment). In this case, the issue is referred to the jurisdiction. When it comes to modern law, some states have determined some penalties about exposal, restricted the media freedom and implemented large amount of indemnities for the exposals occurred through media.
