Bir Vakıa Olarak Medya Teşhiri ve Etkileri -İslam ve Hukuk Açısından Karşılaştırmalı Bir İnceleme-

When it comes to modern law, some states have determined some penalties about exposal, restricted the media freedom and implemented large amount of indemnities for the exposals occurred through media.

Teşhirin normal ve anormal olan çeşitleri vardır. Duruma göre de hükmü değişir; mubah veya haram teşhir gibi. Hüküm değiştiği gibi ceza da değişir. Fakihler, teşhirin tazminatı konusunda üç farklı görüş ortaya koymuşlardır. Birincisi, manevi zararların tazminatının maddi şekilde ödenmesinin caiz görülmesidir. İkincisi; her durumda manevi zararların tazminin caiz olmamasıdır. Üçüncüsü ise; manevi zararların ta'zir yoluyla maddi olarak ödenmesinin caiz olmasıdır. Bu durumda iş, yargıya taşınır. Modern hukuka gelince, bazı devletler, teşhir suçuyla ilgili bazı cezalar koymuşlar, basın hürriyetini sınırlamışlar ve basına yansımış teşhir için büyük miktarda maddi tazminatlar getirmişlerdir.
