Imam Muhammad’s Use of The Phrases ‘Yanbaghī’ and ‘Lā Yanbaghī’ in Al-Muwatta Pertaining to Taklifi Rulings

Abstract

Imām Muḥammad al-Shaybānī’s (d. 189/805) transmission of al-Muwaṭṭaʾ, which reflects the unity of hadith and fiqh, constitutes an important source for understanding the legal terminology of the formative Islamic period. It is known that, prior to the systematic codification of legal theory (uṣūl al-fiqh), fatwā expressions carried more flexible semantic ranges; in this context, terms such as yanbaghī and lā yanbaghī reflect a period in which prescriptive rulings were not expressed through fixed and rigid categories. While previous studies have generally examined such evaluative expressions on a broader scale -across various texts and jurists- this study restricts the subject specifically to their occurrences in al-Muwaṭṭaʾ, thereby providing a focused and delimited analysis that reveals the function of these terms within early Ḥanafī thought. The research was conducted through qualitative methodology based on literature review, identifying all relevant occurrences of these terms in al-Muwaṭṭaʾ and analyzing them in the context of the afʿāl al-mukallafīn. The findings demonstrate that yanbaghī appears four times with the meaning of obligatory (wājib), seven times indicating sunnah, and nine times implying commendable (mustaḥabb). Conversely, lā yanbaghī appears forty-five times with varying degrees of discouragement or prohibition, such as makrūh, not permissible, not lawful, and ḥarām. These results shed light on the semantic narrowing of fatwā terminology in later periods and reveal the flexible approach adopted by al-Shaybānī in formulating legal judgments.
