Exemptions Granted to Women in Islamic Law: The Example of Hajj

Abstract

The religion of Islam has maintained a balance based on justice between men and women in terms of rights and responsibilities. Women have the same rights as men, including the right to life, as well as other rights such as education, health, and fair trial. However, there are also certain areas, such as acts of worship (ʿibādāt), transactions (muʿāmalāt), and punishments (ʿuqūbāt), where rights and responsibilities differ. Nonetheless, Islam has acknowledged the true value of women by attributing superiority not to rights and responsibilities but solely to taqwā. Islamic jurists have also applied the principle of facilitation for women based on necessity in their ijtihads, which they carried out within the framework of the texts (nass). In this context, women experiencing menstrual or postnatal bleeding have been granted certain allowances in worship, such as prayer, fasting, and Hajj, as long as they remain in this state. This study focuses on the exemptions granted to women in the hajj ritual. Thus, it is aimed to refute the claim that Islam does not give women the value they deserve, specifically in the hajj ritual. In the scope of the study, classical and contemporary sources have been reviewed, and data related to the topic have been collected and evaluated. As a result of the research, it was concluded that Islamic law gives due value to women and provides convenience during the pilgrimage as in other acts of worship.
